By accessing or using ActReady ("the Service"), operated at getactready.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and ActReady ("we," "us," or "our"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of service

ActReady is a software-as-a-service platform that helps businesses assess and manage compliance with the EU Artificial Intelligence Act (EU AI Act). The Service includes:

• AI system risk classification tools
• AI-powered compliance document generation
• Obligation tracking and monitoring dashboards
• Compliance status reporting

ActReady is a compliance assistance tool, not a law firm or legal advisor. The information, documents, and classifications provided by our Service are for informational and operational purposes only and do not constitute legal advice.

While we strive to align our tools with the EU AI Act's requirements, regulatory interpretation may evolve, and compliance ultimately depends on the specific circumstances of each AI system and organization. ActReady does not guarantee that use of our platform will result in regulatory compliance. We are not liable for any regulatory actions, fines, or penalties resulting from your reliance on our tools.

4. Accounts and registration

To access certain features, you must create an account. You agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.

5. Subscriptions and payment

ActReady offers free and paid subscription plans. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page.

• Paid plans are billed monthly or annually, depending on your selection
• All fees are in US dollars unless otherwise stated
• Payments are processed securely through Stripe
• Paid plans include a 14-day free trial — you will not be charged during the trial period
• You may cancel your subscription at any time; access continues until the end of the current billing period
• Refunds are handled on a case-by-case basis — contact hello@getactready.com

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to compete directly with ActReady
• Resell or redistribute the Service without our written consent
• Upload malicious code or content to the platform

7. Your data

You retain ownership of all data you input into the Service, including AI system descriptions, organization details, and any other content you provide ("Your Data").

You grant us a limited, non-exclusive license to use Your Data solely for the purpose of providing and improving the Service. We will not sell, share, or use Your Data for any purpose other than operating the Service, as described in our Privacy Policy.

You are responsible for maintaining backups of Your Data. While we take reasonable measures to protect and preserve data, we are not liable for any loss or corruption of Your Data.

8. AI-generated content

Documents and content generated by our AI tools are produced based on the information you provide and the capabilities of our AI systems. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and validating all generated documents before use
• Generated documents should be reviewed by qualified personnel before submission to regulatory authorities
• We do not guarantee the accuracy, completeness, or legal sufficiency of any generated content

You own the documents generated through the Service and may use them for your compliance purposes.

9. Intellectual property

The Service, including its design, code, features, documentation, and branding, is owned by ActReady and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

10. Limitation of liability

To the maximum extent permitted by applicable law, ActReady and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ActReady from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Service availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

13. Modifications to terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Termination

Either party may terminate this agreement at any time. You may terminate by canceling your subscription and ceasing use of the Service. We may terminate or suspend your access for violation of these Terms or for any reason with 30 days' notice.

Upon termination, your right to use the Service ceases immediately. You may request an export of Your Data within 30 days of termination.

15. Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
