EU AI Act for Fintech: Credit Scoring, Fraud Detection, and What's Actually High-Risk
Financial services has one of the highest concentrations of high-risk AI under the EU AI Act. If you're building or deploying AI in lending, insurance, investment, or payments, there is a good chance you are subject to the full suite of Annex III obligations before August 2, 2026.
What counts as high-risk fintech AI
Annex III Point 5 covers AI systems used in access to essential private services. For financial services, this specifically includes:
- Credit scoring and creditworthiness assessment — any AI that evaluates whether a person or business should receive a loan, credit card, or financing
- Insurance risk pricing — AI used to determine premiums, eligibility, or terms for insurance products
- Benefits eligibility — AI used in decisions about access to financial support or services
These are not edge cases. If your product makes or assists credit decisions in the EU, you are operating a high-risk AI system by definition.
What about fraud detection?
This is where fintech teams often get confused. Internal fraud detection — systems that flag transactions for human review within your own operations — generally does not trigger Annex III high-risk classification. The Act is focused on AI that makes consequential decisions about individuals, not internal security tooling.
However, if your fraud detection system results in account suspension, denial of service, or other outcomes that directly affect customers, the picture is less clear. The distinction between "internal tooling" and "AI affecting individuals" is one regulators will look at carefully.
What high-risk fintech AI must do
Risk management system (Article 9)
You must establish and maintain a continuous risk management process covering identified risks across the system lifecycle — including accuracy failure, model drift, adversarial inputs, and discriminatory outputs across demographic groups.
Training data governance (Article 10)
Your training data must be documented, bias-checked, and representative of the population your model will be applied to. If your credit model was trained on historical data that reflects past discrimination, that needs to be identified and addressed — not just noted.
Annex IV technical documentation
Before placing your system on the market or putting it into service, you must have a complete nine-section technical file covering system architecture, training methodology, validation results, accuracy metrics by demographic group, and post-market monitoring plans.
Human oversight (Article 14)
Fully automated credit decisions without any human oversight mechanism are not compliant. You must build in the ability for humans to monitor, intervene in, and override model outputs — and document that process.
Accuracy and robustness (Article 15)
Your system must be tested for accuracy across demographic groups. Disparate impact — where a model produces systematically different outcomes for different groups without justification — is a specific target of EU AI Act enforcement in financial services.
GPAI layer: if you build on foundation models
Many fintech companies now build credit or risk models on top of general-purpose AI models like GPT-4 or Claude. If you do, you have deployer obligations under Chapter V of the Act in addition to your Annex III high-risk obligations. These are separate and stack on top of each other.
What to do before August 2
- Classify each AI system in your product separately — a credit scoring model and a customer chatbot have completely different obligations
- Start Annex IV technical documentation now — this is typically the longest piece of work for fintech companies
- Run bias testing across your primary demographic groups and document the results
- Review your automated decision-making disclosures to customers — are they specific enough about how AI is being used?
